A former Otter Tail County deputy plans to plead guilty to misconduct of a public employee in a deal where a charge of DWI will be dismissed.
Kelly Backman was part of a pursuit in Fergus Falls in October of last year that ended in a collision that killed a Fergus Falls couple. Backman and another deputy were chasing a drug suspect.
A blood test later showed that Backman was under the influence of fentanyl at the time of the crash. The plea agreement calls for 30 days in jail or electronic home monitoring. A judge will make the final decision.
An assistant Clay County attorney was assigned as the prosecutor at the request of the Otter Tail County Attorney’s Office.
