Senator Nicole Mitchell to Resign Following Burglary Conviction

(Woodbury, MN) — Minnesota State Senator Nicole Mitchell will resign from the legislature by 5 p.m. on Monday, August 4th, according to her attorney Dane DeKrey. He says Mitchell wants time to wrap up legislative work and help her staff transition.

Mitchell was convicted Friday of two counts of burglary after breaking into her stepmother’s Detroit Lakes home in April 2024. She was found in the basement wearing black and carrying burglary tools. Mitchell initially claimed she was retrieving personal items belonging to her late father, but later testified she was checking on her stepmother, who has Alzheimer’s.

DeKrey says jail time is likely.

Reaction from state lawmakers is coming in. Republican Senate Minority Leader Mark Johnson of East Grand Forks says, “Senator Mitchell was convicted of two felonies; she doesn’t get to give the Senate two weeks’ notice. Democrats shielded Mitchell for 15 months to protect their political power, but a jury needed just three hours to confirm what was already clear: she shouldn’t be a senator.”

DFL Senate Majority Leader Erin Murphy of St. Paul says, “Nicole Mitchell has gotten the due process she is entitled to and was convicted by a jury of her peers. Her attorney conveyed today that she will resign her Senate seat by Monday, August 4. With the clarity brought by the resolution to this case, the Senate DFL Caucus will continue to focus on issues that improve the lives of Minnesota families and communities.”
