Washington D.C. (MNN) – Federal prosecutors will not seek the death penalty against Vance Boelter, the man accused of killing former Minnesota House Speaker Emerita Melissa Hortman and her husband.

A spokesperson for the U.S. Department of Justice says capital punishment is off the table, even if Boelter pleads guilty to the state and federal charges he faces.

Boelter is accused of fatally shooting the Hortman’s and critically wounding State Senator John Hoffman and his wife, Yvette, in June 2025. Federal charges also allege he attempted to shoot the Hoffmans’ daughter, Hope.

Boelter faces multiple counts, including murder and stalking. His next court appearance is scheduled for October 16th for a motions hearing.
