St. Paul, MN – Minnesota is suspending the use of alcohol breath testing machines in suspected DWI cases statewide. The Bureau of Criminal Apprehension (BCA) directed law enforcement agencies to stop using the DataMaster devices due to concerns over their reliability.
The BCA says nearly 20 cases in Hennepin County and more than 100 in Olmsted County could be affected. In Aitkin County, prosecutors have already dismissed charges in at least one case and in Winona County about 45 tests were compromised, and charges based on faulty data are also being dropped.
Officials are now reviewing impacted cases and working to determine next steps.
